By accessing or using Pereira Systems ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
Pereira Systems provides AI-powered lead management, SMS automation, and customer relationship management tools for home service contractors. Our services include:
- Automated SMS responses to missed calls and website inquiries
- AI-powered lead qualification and follow-up
- Lead pipeline and opportunity tracking
- Automated review request campaigns
- Website builder for contractor businesses
3. SMS Messaging Terms
By using our SMS features, you agree to the following:
3.1 Consent Requirements
You are responsible for obtaining proper consent from your customers before sending them SMS messages through our platform. You must:
- Obtain express written consent before sending marketing messages
- Clearly disclose that customers will receive SMS messages from your business
- Provide clear opt-out instructions in your messages
- Honor all opt-out requests immediately
3.2 Message Content
You agree not to send messages that:
- Contain illegal, harmful, or offensive content
- Violate any applicable laws or regulations
- Misrepresent your identity or business
- Contain spam or unsolicited commercial messages
3.3 TCPA Compliance
You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all other applicable federal, state, and local laws regarding SMS messaging. Pereira Systems provides tools to help with compliance but does not guarantee compliance.
3.4 Message Rates
Standard message and data rates may apply to recipients of SMS messages. You must inform your customers that message and data rates may apply.
3.5 Opt-Out Handling
Our system automatically processes STOP, UNSUBSCRIBE, and similar opt-out keywords. When a recipient opts out, they will no longer receive messages from your business through our platform.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
5. Payment Terms
Paid subscriptions are billed monthly. You authorize us to charge your payment method on file for all applicable fees. Subscriptions auto-renew unless cancelled before the renewal date.
6. Cancellation and Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months of service.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Pereira Systems and are protected by international copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
Pereira Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Pereira Systems from any claims, damages, or expenses arising from your use of the Service, including but not limited to claims related to SMS messaging and TCPA violations.
10. Modifications to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
